Conditional Discharge

Conditional discharge and probation are two of the most frequently used sentencing options. Both of these sentencing options are distinguished by terms or conditions placed on the convicted person and are designed to control the future behavior of the defendant and society as a whole.

A conditional discharge is similar to probation, except it may be used for any violation of law, including petty offenses such as traffic infractions. The terms of conditional discharge can include such things as counseling, defensive driver program (point reduction) and community service, etc.

The conditional discharge is usually used for minor violations of law. In effect a conditional discharge is like a probation term without a report being done by a probation officer and without post-sentence reporting to a supervising officer. Courts may utilize court personnel or community based agencies to assist the court in administering a conditional discharge.
